These Terms of Service ("Terms") are a binding agreement between you and Voyage Technologies Limited ("SafariShare", "we", "us" or "our"), a company incorporated in the Republic of Uganda under the Companies Act, 2012 (registration number 80020002070650). They govern your access to and use of the SafariShare websites, mobile applications, and related services (together, the "Service").
Please read these Terms carefully. They include rules on acceptable use and additional terms for drivers and operators. By creating an account, booking a ride, offering a ride, or otherwise using the Service, you agree to these Terms and to our Privacy Policy (which also explains our use of cookies), each of which is incorporated by reference. If you do not agree, you must not use the Service.
SafariShare is a technology platform that connects travellers with independent transport providers. We are not a transport carrier and we do not operate vehicles. Any transport is provided by third parties, and your travel is at your own risk.
SafariShare is an online marketplace and discovery platform that helps travellers find, plan, book and pay for transport, and helps drivers and operators offer it. Depending on your location and the features available to you, the Service may include:
Some features are offered only in certain markets, on certain platforms, or to certain users, and may be added, changed, suspended or withdrawn at any time. We make no commitment that any particular feature will be available to you.
Our role is limited. We provide the technology that enables bookings and connections. The transport itself is a separate contract between you and the relevant driver or operator (each a "Transport Provider"). We are not a party to that contract, we are not a transport operator, travel agent, or carrier, and we do not employ Transport Providers.
You may browse parts of the Service without an account. To book, offer rides, or use most features, you must create an account and be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding contract.
Accounts are created and secured using one-time passcodes sent to your phone number or email address. You are responsible for keeping access to that phone number, email account and device secure, and for all activity that occurs under your account. You agree to provide accurate, current and complete information and to keep it up to date. Tell us promptly at support@safarishare.co if you suspect unauthorised use of your account.
You may not create an account for anyone else, use another person's identity, or maintain more than one account in a way intended to evade suspension or our policies.
When you request a booking, you make an offer to travel on the terms shown at that time (route, date, departure, seats, passengers and price). A booking is confirmed only when payment is completed (or, for some carpool requests, when the driver accepts) and the Service confirms it. Until then, availability and pricing are not guaranteed and may change.
Where a booking generates a ticket, seat reference or confirmation code, you are responsible for presenting it as required by the Transport Provider. For operators that are not yet enabled for online booking, the Service may display schedule and contact information only, and you arrange travel directly with the operator.
Prices are shown before you confirm a booking and are stated in Ugandan Shillings (UGX) unless indicated otherwise. The price you pay typically comprises the fare set by, or shared with, the Transport Provider, plus a service fee payable to SafariShare for use of the platform. The total amount is shown to you before payment.
Our service fee is included in the total shown to you, so the amount you see at checkout is the amount you pay. We may change our fees from time to time; the fee in effect when you book is the one reflected in that total.
Payments are processed by third-party payment providers (for example, mobile-money and card processors). By paying, you authorise the relevant payment provider and us to charge the displayed amount, and you agree to the payment provider's own terms. We do not store full card numbers; payment credentials are handled by the payment provider. We are not responsible for failures, delays or declines caused by your bank, mobile-money provider or payment processor.
Where fares for a journey are collected by SafariShare on a Transport Provider's behalf, we remit them to the Transport Provider net of our service fee in accordance with our arrangement with that provider. Carpool fares are intended to share a driver's travel costs and are not a commercial profit.
Cancellation and refund rights depend on the type of booking and the Transport Provider's policy, which is shown or made available at the time of booking.
Where a refund is due, it is processed back to your original payment method and the time to appear depends on your bank or payment provider. The SafariShare service fee may be non-refundable except where required by law or where we cancel a booking ourselves. If a Transport Provider cancels or materially changes a trip, contact them first; you can also contact us at support@safarishare.co and we will assist where we can.
Carpooling and commuting connect private individuals to share journeys and costs. Carpool drivers are not professional or commercial transport operators, and the amounts contributed by passengers are intended only to share the costs of the journey (such as fuel), not to generate profit.
If you offer rides as a driver, you confirm that you hold a valid driving licence, that your vehicle is roadworthy, lawfully registered and adequately insured for the journeys you offer, and that carrying passengers in this way is lawful for you. If you travel as a passenger, you understand that carpool drivers are private individuals and you choose to travel with them at your own discretion and risk. Additional obligations for drivers are set out in the terms for drivers and operators below.
Formal transport operators list their services and, where enabled, accept bookings through the Service. Before an operator appears on the platform we carry out a verification process which may include checking operating permits, route details and contact information. This verification is a reasonable-efforts process for discovery purposes; it is not a guarantee of an operator's safety, punctuality, quality, legal compliance or fitness, and it does not make us responsible for their services.
Operators remain solely responsible for operating their services, including vehicles, drivers, passenger safety, licensing, permits, regulatory compliance and fare collection. The terms governing operators and drivers are set out in the terms for drivers and operators below.
Event listings are provided for discovery and to help you arrange rides to and from a venue. SafariShare is not the organiser of any event, does not sell admission tickets, and does not control event capacity, entry, timing, cancellation or safety. Event details are sourced from organisers or public information and may change or be inaccurate. Any arrangement to attend an event is between you and the organiser.
Where parcel features are available, you may arrange for an item to be carried along a journey. You must accurately describe the item and must not send anything illegal, dangerous, perishable, prohibited or restricted, or anything you are not entitled to send. You are responsible for adequately packaging items and for any loss, damage or liability arising from what you send. We may refuse or remove parcel requests at our discretion.
The Service may let users leave reviews and ratings, and may display trust badges that reflect signals such as a confirmed phone number, identity or document verification, and travel history. Badges and ratings are indicative only. They are not a guarantee or endorsement of any person's identity, character, conduct, safety or suitability, and they do not replace your own judgement.
We do not conduct criminal-background checks on drivers, operators or passengers unless we expressly state otherwise for a specific feature. Verification is limited to the documents and signals described in our Privacy Policy. Reviews must be honest, based on a genuine experience, and must comply with the acceptable use rules below.
These acceptable-use rules apply to everyone who uses the Service: passengers, drivers, operators and agents. You must use the Service lawfully, honestly and respectfully, and only for its intended purpose. You must comply with all applicable laws, including traffic, transport, licensing, tax and data-protection laws, and you must treat other users and our staff with courtesy and without discrimination or harassment.
You must not:
If you see conduct that breaches these rules, report it through the Service or contact us at support@safarishare.co; in an emergency, contact local authorities first. Where we believe these rules have been breached, we may take proportionate action as described under Suspension and Termination.
You retain ownership of content you submit (such as profile details, photos and reviews). You grant us a non-exclusive, worldwide, royalty-free licence to host, use, reproduce, adapt and display that content as needed to operate, promote and improve the Service. You are responsible for your content and confirm you have the rights to share it.
The Service, including its software, design, text, graphics, the SafariShare name and logo, and other content we provide, is owned by or licensed to Voyage Technologies Limited and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, reverse-engineer, scrape, or create derivative works from the Service except as permitted by law or with our written consent.
This section applies to anyone who offers transport through the Service, whether as a private carpool driver or as a transport operator (each a "Provider"). A separate signed listing or commercial agreement, where one exists, prevails over this section to the extent of any conflict.
SafariShare is an information, discovery and booking platform only. It does not operate vehicles or transport passengers. You, the Provider, remain fully and solely responsible for operating your transport services.
We may list your services on SafariShare and on journey-planning tools such as Google Maps and Google Transit, including by structuring your service information using the General Transit Feed Specification (GTFS) or similar formats. This does not create any employment, agency, partnership or joint-venture relationship; you are an independent provider, and each contract of carriage is between you and the passenger.
If you offer rides as a private driver, you confirm that you hold a valid driving licence; that your vehicle is roadworthy, lawfully registered and adequately insured; that carrying passengers in this way is lawful for you; and that you offer rides on a cost-sharing basis and not as an unlicensed commercial service. If you list services as an operator, you confirm that you hold and will maintain all operating permits, vehicle licences, driver authorisations and insurance required by law, and that you comply with all applicable transport and safety regulations.
We may ask you to provide information and documents (such as identity, licence, insurance, permits, routes, schedules and fares) and may verify them before or after your services go live. Any review or verification we carry out is for listing and discovery purposes only. It does not transfer any of your responsibilities to us, and it is not a warranty by us of your services.
You authorise us to collect, organise, publish and update information about your services (including your business or driver name, contact details, routes, stops, schedules and fares) on SafariShare platforms and related journey-planning systems, and you grant us permission to display this for the duration of your use of the Service. You are responsible for the accuracy of that information and should keep it up to date, especially seat availability and fares. Listing is provided at no cost. Where online booking is enabled for you, you agree to honour confirmed bookings; for bookings and payments processed through the platform we charge a service fee or commission at the rate agreed with you and remit the balance to you in accordance with our arrangement with you. We may offer additional services (such as ticketing, digital payments or analytics) under separate terms.
You remain solely responsible for operating your transport services, including:
SafariShare does not operate vehicles or transport passengers and is not responsible for your transport operations, service delays, transport incidents, passenger claims, or operational issues relating to your services.
When you receive passenger personal data through the Service to fulfil a booking, you must use it only to provide the trip, keep it secure, and comply with the Data Protection and Privacy Act, 2019 and our Privacy Policy. You must not use passenger data for marketing or any other purpose without a lawful basis and the passenger's consent. Each party will treat the other's confidential business information with reasonable care and will not disclose it without consent except where required by law.
The Service relies on, and may link to, third-party services (such as mapping, payment, messaging and analytics providers). Your use of those services may be governed by their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the Service will be uninterrupted, secure or error-free, that information (including schedules, prices, availability, locations and estimated times) is accurate or complete, or that any Transport Provider will perform as expected. We do not guarantee the quality, safety, legality, punctuality, suitability or ability of any Transport Provider, passenger or other user. You travel and transact with other users at your own risk.
To the fullest extent permitted by law, SafariShare and its directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your use of (or inability to use) the Service or any transport arranged through it.
To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to the Service or these Terms is limited to the total amount of service fees you paid to us in respect of the booking giving rise to the claim in the three (3) months before the event giving rise to the liability.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud, or for any other liability that applicable law does not allow to be limited.
You agree to indemnify and hold harmless SafariShare and its directors, employees and agents from and against any claims, liabilities, damages, losses and reasonable expenses (including legal fees) arising out of your use of the Service, your breach of these Terms or applicable law, or your infringement of the rights of any third party.
We may suspend, restrict or terminate your access to the Service, or remove content, if we reasonably believe you have breached these Terms or any policy, created risk or legal exposure, or where required by law. Action we take will be proportionate to the circumstances and may include a warning, removing content, limiting features, suspending or terminating accounts, withholding or reversing payments, and reporting to authorities where appropriate. For Providers, either party may also end the arrangement on thirty (30) days' written notice, and we will remove your listing within a reasonable time.
You may stop using the Service and close your account at any time, by asking us or, where the feature is available, using account deletion in the app. Provisions that by their nature should survive termination (including payment obligations, disclaimers, limitations of liability, indemnities and dispute resolution) will survive.
If you download our mobile application from a third-party app store (such as the Apple App Store or Google Play), your use is also subject to that store's terms. We grant you a personal, limited, non-transferable licence to use the application on devices you own or control. The application may update automatically. Where an app store's rules require, the store and its affiliates are third-party beneficiaries of these Terms in respect of your licence to use the application, but they are not responsible for the application or for providing support.
Apple, Google and similar app-store operators are not responsible for the Service, any claims relating to it, or any support, and these Terms are between you and SafariShare only.
We may modify the Service and these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example by posting the updated Terms with a new "last updated" date or through the Service. Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect means you accept the updated Terms.
These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of the Republic of Uganda, without regard to conflict-of-law principles.
If a dispute arises, you and SafariShare will first try to resolve it amicably through good-faith consultation. If it is not resolved within thirty (30) days, the parties may refer it to mediation. If mediation fails, the dispute will be referred to and finally resolved by arbitration under the Arbitration Rules of the Uganda Centre for Arbitration. The arbitration will have one arbitrator, the seat of arbitration will be Kampala, Uganda, and the proceedings will be conducted in English. Nothing in this section prevents either party from seeking urgent interim relief from a competent court, or limits any right you may have to bring a claim before a relevant consumer or data-protection authority.
These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign ours to an affiliate or successor. We are not liable for delays or failures caused by events beyond our reasonable control.
